GENERAL TERMS AND CONDITIONS (GTC)

OVERVIEW
Welcome to JJCurated. The contracting party and operator of this online store and website is JJ Curated GmbH, Walfischgasse 1/17, 1010 Vienna, Austria.
The terms “we”, “us” and “our” refer to JJ Curated GmbH.
We operate this online store and website, including all related information, content, features, tools, products and services, to provide you with a carefully curated shopping experience (the “Services”). Our Services are technically provided through Shopify.
These General Terms and Conditions (“GTC”) govern the use of our Services and contracts concluded through our online store. Any additional policies referred to herein, in particular our Privacy Policy and Returns Policy, also apply where relevant.
Please read these GTC carefully. By using our Services, you agree to these terms. Any purchase contract is governed by the version of these GTC that was valid and incorporated into the ordering process at the time the order was placed.
Where these GTC distinguish between consumers and businesses, these terms shall have the meaning given to them under applicable law, in particular the Austrian Consumer Protection Act (Konsumentenschutzgesetz – KSchG).
SECTION 1 – ACCESS AND CUSTOMER ACCOUNTS
To enter into a contract through our online store, you must have full legal capacity or act with the consent of your legal representative where such consent is required by law.
To use certain Services or place an order, you may be required to provide information such as your email address, billing address, shipping address and payment details.
You are responsible for ensuring that all information you provide is accurate, current and complete and that you are authorised to provide such information to us.
If you create a customer account, you are responsible for keeping your login credentials confidential and protecting them from unauthorised access. Please notify us without undue delay if you suspect that your account has been used without your permission.
SECTION 2 – OUR PRODUCTS
We make every effort to represent our products and their characteristics as accurately as possible in our online store.
Please note, however, that colours, textures, finishes and the overall appearance of a product may vary slightly depending on the device used to access our website and individual screen or display settings.
Many products offered by JJCurated are made entirely or substantially by hand by skilled artisans using traditional production techniques.
As a result, individual pieces may show subtle variations in shape, dimensions, colour, glaze, texture, grain, patina, surface, detailing and overall appearance. Where such variations are typical of the relevant handcrafted production method or natural material and are consistent with the product description, they form part of the individual character of the product.
This applies in particular to our Signature Ceramics, where every piece is individually handcrafted. Decorative elements – down to the smallest flowers, leaves or ornamental details – are shaped, applied and finished by hand by experienced artisans. No two pieces are therefore exactly alike.
Ceramic products may also show variations resulting from the glazing and firing process, including differences in colour tones, glaze effects, patterns, surface texture and finish.
Likewise, handcrafted glass, brass, bamboo, reclaimed wood and other natural materials may display individual variations in colour, transparency, patina, grain, texture or surface appearance.
These characteristics, where typical of the craftsmanship or material, do not in themselves constitute a defect.
Your statutory warranty rights remain fully unaffected. If a product does not conform to the contractually agreed or legally required characteristics, the applicable statutory warranty provisions shall apply.
Product descriptions and our assortment may be changed at any time with respect to future orders. We also reserve the right to discontinue products or limit available quantities.
SECTION 3 – ORDERS AND CONCLUSION OF CONTRACT
The presentation of products in our online store does not, as a general rule, constitute a binding offer to enter into a purchase contract.
By submitting your order, you make a binding offer to purchase the products contained in your shopping cart.
After we receive your order, you will receive an electronic confirmation. Unless expressly stated otherwise, this confirmation initially only acknowledges receipt of your order.
The purchase contract is concluded when we expressly accept your order or dispatch the goods to you, whichever occurs first.
Before the contract is concluded, we reserve the right to reject an order for objective reasons, for example if a product is unavailable, there is an obvious pricing or system error, or there are reasonable grounds to suspect fraudulent activity.
If payment has already been collected and no contract is concluded, the corresponding amount will be refunded using the original payment method.
Please review your order carefully before submitting it.
Your statutory rights, including any applicable right of withdrawal in distance-selling contracts, remain unaffected by any provisions concerning cancellations.
Additional terms may apply to pre-orders or individually made products. These will be displayed to you before you place your order. Mandatory consumer rights are not restricted by such terms.
Returns and refunds are additionally governed by our Returns Policy.
SECTION 4 – PRICES AND PAYMENT
The price applicable to an order is generally the price displayed in our online store at the time the order is completed.
Unless expressly stated otherwise, prices displayed to consumers include the applicable statutory value-added tax.
Shipping costs and any additional charges will be displayed before the order is placed where they can be calculated in advance.
For deliveries to countries outside the European Union, additional customs duties, import taxes, levies or other charges may apply. Unless expressly agreed otherwise, any such charges imposed by authorities in the destination country are the responsibility of the recipient.
Prices, discounts and promotions relating to future orders may be changed at any time.
Separate terms may apply to limited-time promotions. In the event of a conflict between such promotional terms and these GTC, the more specific promotional terms shall apply to the relevant promotion.
You agree to provide complete and accurate payment and contact information for your order and to notify us of any changes where relevant to the processing of your order.
You may only use payment methods that you are authorised to use.
SECTION 5 – SHIPPING AND DELIVERY
Delivery times stated on product pages or during the ordering process are estimated delivery times unless a binding delivery date has been expressly agreed.
For handcrafted and made-to-order products, stated delivery times may in particular depend on the relevant production process.
For delays caused by circumstances beyond our reasonable control, including delays caused by carriers, customs procedures, natural events or comparable circumstances, we shall only be liable to the extent required by mandatory law.
Your statutory rights in the event of delayed delivery remain unaffected.
In contracts with consumers, the risk of loss of or damage to the goods generally passes to the customer only when the goods are delivered to the customer or to a third party designated by the customer other than the carrier.
Where a consumer independently enters into a contract with a carrier without using a shipping option offered by us, risk passes in accordance with the applicable statutory provisions upon delivery of the goods to that carrier.
In contracts with businesses, risk passes, to the extent permitted by law and unless otherwise agreed, upon delivery of the goods to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY
All content made available through our Services, including in particular trademarks, names, logos, text, photographs, graphics, illustrations, videos, audio files, product presentations and the design, selection and arrangement of such content, is owned by JJ Curated GmbH, our partners or the respective rights holders and is protected under applicable Austrian, European and international intellectual property laws.
You may use our Services for personal, non-commercial purposes in accordance with these GTC.
Without the prior consent of the respective rights holder, content from our website may not, in particular, be reproduced, modified, distributed, made publicly available, commercially exploited or used to create derivative works, unless such use is expressly permitted by law.
Use of our Services does not transfer to you any rights in trademarks, copyrights, designs or other intellectual property belonging to JJ Curated GmbH, Shopify or any third party.
The name “JJCurated”, company identifiers, logos, product names, designs and other distinctive signs may not be used for commercial purposes without prior permission.
Third-party trademarks and identifiers remain the property of their respective owners.
SECTION 7 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES
Our website may provide access to features, tools or services operated by third parties.
Such services may be subject to the respective third party’s own terms and privacy policies.
Where such tools are not operated or controlled by us, we cannot guarantee their uninterrupted availability or error-free operation.
Use of optional third-party services is subject to the terms of the respective provider.
Nothing in this section limits mandatory statutory rights or our liability for our own conduct.
We may introduce additional features, tools or resources into our Services in the future. Where these are provided by us, the relevant provisions of these GTC shall also apply.
SECTION 8 – THIRD-PARTY LINKS
Our website may contain links to websites or online platforms operated by third parties.
For third-party content to which we merely provide a link and which we do not adopt as our own, we accept responsibility only to the extent required by law.
When visiting external websites, we recommend reviewing the relevant terms and conditions, privacy policies and security information.
Contracts for products or services entered into directly with a third party are governed by the terms of that third party.
Your mandatory statutory rights against JJ Curated GmbH remain unaffected.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our online store is technically provided through Shopify.
However, purchase contracts relating to products offered by JJCurated are concluded directly with JJ Curated GmbH. Shopify is not the seller of our products and does not become a party to the purchase contract between you and JJ Curated GmbH.
Questions, claims or statutory rights relating to a purchase contract concluded with us should therefore generally be directed to JJ Curated GmbH.
Any statutory claims against Shopify arising from Shopify’s own acts or services remain unaffected by this provision.
SECTION 10 – PRIVACY
The processing of personal data in connection with our Services is governed by our Privacy Policy.
As our online store is technically provided through Shopify, Shopify also processes certain personal data relating to access to and use of our online store.
Further information can be found in our Privacy Policy and in Shopify’s privacy information.
SECTION 11 – FEEDBACK AND REVIEWS
If you voluntarily submit reviews, comments, suggestions, ideas or other feedback to us, any rights you already hold in such content generally remain unaffected.
Where you expressly provide content for publication, you grant us, to the extent necessary, a non-exclusive, worldwide and royalty-free right to store, reproduce, publish and use such content in connection with JJCurated and for the communication and promotion of our products and Services.
This applies only where you hold the rights required to grant such permission.
Where you submit ideas or suggestions without an express confidentiality agreement, this does not generally create any obligation on our part to compensate you or implement such ideas or suggestions.
You are responsible for ensuring that any content you publish or submit does not infringe the rights of third parties and does not contain unlawful, offensive, misleading or harmful material.
We reserve the right, to the extent permitted by law, not to publish or to remove content that is unlawful or violates these GTC.
SECTION 12 – ERRORS AND INCORRECT INFORMATION
Despite careful review, our website may occasionally contain typographical errors, technical errors, incorrect information or omissions relating, for example, to product descriptions, prices, promotions, shipping costs, delivery times or availability.
Before a contract is concluded, we reserve the right to correct such errors and update the relevant information at any time.
Once a contract has been concluded, any correction, amendment or cancellation of the contract shall be governed by the applicable statutory provisions.
Your statutory rights remain unaffected.
SECTION 13 – PROHIBITED USES
You may use our Services only for lawful purposes.
In particular, you may not use our Services:
(a) for unlawful or fraudulent purposes;
(b) in violation of applicable laws or regulations;
(c) to infringe our intellectual property rights or the rights of third parties;
(d) to harass, threaten, insult or harm another person;
(e) to knowingly transmit false or misleading information;
(f) to distribute malicious software, viruses or comparable harmful code;
(g) to transmit unsolicited advertising, spam or similar communications;
(h) to impersonate another person or organisation without authorisation;
(i) to circumvent technical security or access restrictions;
(j) to systematically collect, extract or commercially reuse our content through automated means in breach of our technical restrictions or legal rights.
Automated systems, scraping tools, bots or AI agents may not access or use our Services contrary to expressly indicated technical access restrictions or in a manner that compromises the functionality or security of our Services.
In the event of a serious or repeated violation, we may restrict or suspend access to our Services to the extent permitted by law.
SECTION 14 – AUTOMATED AGENTS
This section applies to software or services that act autonomously or semi-autonomously on behalf of a person or organisation when accessing or interacting with our Services (“Agents”).
Where technically provided for or requested by us, such Agents must be identifiable as automated systems and may not deliberately conceal their identity.
Agents may not circumvent CAPTCHAs, security measures, access restrictions or other technical measures intended to prevent or limit automated access.
We may technically restrict automated access to our Services for reasons including security, system stability, protection of intellectual property or prevention of misuse.
Mandatory statutory rights remain unaffected.
SECTION 15 – SUSPENSION AND TERMINATION OF ACCESS
We may restrict, suspend or terminate access to a customer account or certain features of our Services for good cause.
Good cause may include, in particular, reasonable indications of fraudulent or unlawful activity, serious breaches of these GTC or threats to the security of our Services.
Where circumstances permit and no security or misuse concerns prevent us from doing so, we will inform you of such action.
Suspension or termination of a customer account does not generally affect purchase contracts that have already been validly concluded or any statutory rights and obligations arising from such contracts.
Outstanding payment or other obligations under existing contracts remain unaffected.
SECTION 16 – STATUTORY WARRANTY AND AVAILABILITY OF THE SERVICES
All goods sold by us are subject to the applicable statutory warranty provisions.
In particular, we are responsible for ensuring that goods delivered by us conform to the contractually agreed and legally required characteristics.
The typical characteristics of handcrafted products and natural materials described in Section 2 shall be taken into account where they form part of the agreed characteristics of the product.
Your statutory warranty rights are not restricted by these GTC.
Any voluntary guarantee going beyond the statutory warranty applies only where we expressly provide such a guarantee for a specific product.
We make reasonable efforts to provide our website and digital Services reliably and securely. However, uninterrupted or completely error-free availability cannot be guaranteed at all times.
Temporary restrictions may arise in particular due to technical maintenance, disruptions affecting infrastructure or third-party providers, or other circumstances beyond our reasonable control.
SECTION 17 – LIABILITY
Our liability towards consumers is governed by the applicable statutory provisions.
We shall be fully liable for damage caused intentionally or through gross negligence by us or by persons for whom we are legally responsible, as well as for damage resulting from injury to life, body or health.
Mandatory statutory liability, in particular under applicable product liability law, remains fully unaffected.
To the extent permitted by law, we shall not be liable towards consumers for property damage or purely financial loss caused by slight negligence unless an essential contractual obligation has been breached.
Where an essential contractual obligation is breached through slight negligence, our liability shall, to the extent permitted by law, be limited to the type of damage that is typical and reasonably foreseeable for the relevant contract.
In relation to businesses, liability for property damage and purely financial loss caused by slight negligence is excluded to the extent permitted by law.
In relation to businesses, we shall also not be liable for indirect or consequential loss, loss of profit or loss of anticipated savings where such loss is caused only by slight negligence and such exclusion is legally permissible.
These limitations of liability do not apply in cases of personal injury, intentional misconduct, gross negligence, claims under product liability law or any other case in which liability cannot legally be limited or excluded.
SECTION 18 – RESPONSIBILITY FOR UNLAWFUL USE
You are responsible for using our Services in accordance with applicable law and these GTC.
If you cause damage through culpable unlawful use of our Services or through a culpable infringement of third-party rights, your responsibility shall be determined in accordance with the applicable statutory provisions.
In relation to consumers, this section does not create any obligations extending beyond statutory liability.
Businesses shall, to the extent permitted by law, indemnify us against justified third-party claims arising from culpable unlawful use of our Services or culpable infringement of third-party rights for which they are responsible.
To the extent legally permissible, this also includes reasonable and necessary costs of legal defence.
SECTION 19 – SEVERABILITY
If any provision of these GTC is or becomes wholly or partly invalid, unlawful or unenforceable, the remaining provisions shall remain unaffected to the extent permitted by law.
The applicable statutory provisions shall apply in place of the invalid provision.
In relation to consumers, this provision applies only insofar as it does not restrict mandatory consumer rights.
SECTION 20 – ENTIRE AGREEMENT AND NON-EXERCISE OF RIGHTS
If we do not exercise or enforce a right or provision of these GTC in a particular case, this shall not constitute a waiver of that right for the future.
These GTC, together with any policies incorporated into the ordering process and any individual agreements between you and us, form the contractual basis of the relevant relationship.
In the event of a conflict, individually agreed terms shall take precedence over these GTC.
Mandatory statutory provisions remain unaffected.
SECTION 21 – TRANSFER OF RIGHTS AND OBLIGATIONS
Your statutory rights to assign or transfer claims remain unaffected.
We may transfer rights and obligations under a contract to a legal successor or affiliated company where this does not materially prejudice the rights of a consumer and where such transfer is legally permitted.
A transfer does not release us from obligations that have already arisen unless otherwise provided by law.
SECTION 22 – GOVERNING LAW AND JURISDICTION
These GTC and contracts concluded with JJ Curated GmbH are governed by the substantive laws of Austria, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
In contracts with consumers, this choice of law shall apply only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law that would otherwise apply, in particular the law of the country in which the consumer has their habitual residence.
For consumers, the applicable mandatory statutory provisions govern jurisdiction.
For disputes arising out of or in connection with contracts with businesses, the courts having subject-matter jurisdiction in Vienna, Austria shall have exclusive jurisdiction to the extent legally permissible.
SECTION 23 – HEADINGS
The headings used in these GTC are included for convenience only and do not affect the interpretation of the relevant provisions.
SECTION 24 – CHANGES TO THESE GTC
The current version of these GTC can be viewed on our website at any time.
We may amend these GTC for future contracts where necessary, for example due to changes in applicable law, changes to our Services or operational requirements.
A purchase contract is generally governed by the version of these GTC that was validly agreed at the time the contract was concluded.
A later amendment to the GTC published on our website does not automatically alter an existing contract.
Existing contractual relationships may only be amended where permitted by law or where a valid agreement to that effect is reached between the parties.
Mandatory statutory provisions remain unaffected.
